These Terms and Conditions ("Terms") govern your use of the IndiMove platform, which includes our website, mobile applications, and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.

Definitions

"User" refers to anyone who uses the IndiMove platform, including customers, delivery personnel, and logistics partners.
"Customer" refers to individuals or businesses that use the IndiMove platform to request delivery or logistics services.
"Delivery Personnel" refers to individuals or entities that provide delivery services through the IndiMove platform.
"Logistics Partners" refers to third-party logistics companies or independent contractors that provide logistics services through the IndiMove platform.
"We", "Us", and "Our" refer to IndiMove.

Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. By using our Services, you represent and warrant that you meet these eligibility requirements.

Account Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate, current, and complete.
• Maintain the security and confidentiality of your account login information.
• Notify us immediately of any unauthorized use of your account.

Services Provided

IndiMove provides a platform that connects Customers with Delivery Personnel and Logistics Partners to facilitate last mile delivery and logistics services. The actual contract for the provision of services is between the Customer and the Delivery Personnel or Logistics Partner.

Fees and Payment

Customers are required to pay for the services provided through the IndiMove platform. The applicable fees will be displayed to the Customer before confirming a service request.
Payment must be made through the payment methods provided on the IndiMove platform.
IndiMove reserves the right to change its fees at any time, and will notify Users of any fee changes before they take effect.

User Responsibilities

Customers agree to provide accurate information about the delivery details and ensure that the package is adequately prepared for delivery.
Delivery Personnel and Logistics Partners agree to perform their services with reasonable care and skill.
Users must not use the Services for any unlawful or prohibited activities.

Cancellation and Refund Policy

Customers may cancel a service request within a specified period as outlined in our cancellation policy.
If a service request is canceled outside of the allowable period, the Customer may be charged a cancellation fee.
Refunds will be processed according to our refund policy, which is available on our website and within the app.

IndiMove acts solely as an intermediary between Customers and Delivery Personnel/Logistics Partners. We are not liable for any loss, damage, or injury resulting from the services provided by Delivery Personnel or Logistics Partners.
Our Services are provided "as is" and "as available". We disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

Indemnification

You agree to indemnify, defend, and hold harmless IndiMove, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services.

Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

User Conduct

By using the IndiMove platform, you agree not to:

• Violate any applicable laws or regulations.
• Use the Services for any unlawful or fraudulent purposes.
• Use any automated systems, including robots, spiders, or similar technologies, to access the Services.
• Attempt to interfere with the proper working of the Services, including by disrupting the network or servers connected to the Services.
• Post, upload, or distribute any content that is unlawful, defamatory, obscene, or otherwise objectionable.

Third-Party Links

The Services may contain links to third-party websites or services that are not owned or controlled by IndiMove. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that IndiMove shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Customer Feedback

We value and welcome feedback from our Users. By submitting feedback, you grant us the right to use, reproduce, modify, and distribute the feedback for any purpose, including marketing and promotional purposes, without any compensation to you.

19. Delivery Policy

• Delivery Personnel are responsible for ensuring that deliveries are completed within the estimated time frame provided to the Customer.
• Customers must ensure that someone is available to receive the delivery at the specified address and time. If no one is available, additional fees may apply for re-delivery or return of the package.
• IndiMove is not responsible for any delays or failures in delivery caused by events beyond our reasonable control, including but not limited to natural disasters, traffic conditions, or strikes.

Damage or Loss of Goods

• Delivery Personnel and Logistics Partners are responsible for handling goods with care. In case of damage or loss of goods during transit, Customers must report the issue to IndiMove within 24 hours of delivery.
• Claims for damage or loss will be assessed on a case-by-case basis. IndiMove will facilitate communication between the Customer and the responsible party but is not liable for the resolution of such claims.

Insurance

• IndiMove may offer optional insurance coverage for goods in transit. Details of available insurance options and coverage limits will be provided at the time of booking.
• Customers opting for insurance must comply with the terms and conditions of the insurance policy to make any claims.

User Ratings and Reviews

• Customers may be asked to rate and review Delivery Personnel and Logistics Partners after a service is completed.
• Ratings and reviews should be fair, truthful, and respectful. IndiMove reserves the right to remove any content that violates these principles.

Dispute Resolution

In the event of a dispute between Users (including between Customers and Delivery Personnel/Logistics Partners), IndiMove will make reasonable efforts to facilitate a resolution. However, IndiMove is not responsible for resolving disputes and Users agree to resolve any disputes independently.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by IndiMove, constitute the entire agreement between you and IndiMove regarding the use of our Services, superseding any prior agreements between you and IndiMove relating to your use of the Services.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without IndiMove's prior written consent. Any attempt by you to assign or transfer these Terms will be null and void.
